1. Overview & Agreement

1.1. Platform Services: KarMuqabla provides educational content, learning modules, quizzes, arenas, tournaments, and performance analytics tools for students, parents, teachers, and school administrators. Platform features and available tools may vary based on user role, subscription tier, or institutional affiliation.

1.2. Institutional Precedence: If you access KarMuqabla through a partner school, branch, or sponsored institutional deployment, your institution’s partnership agreement applies alongside these terms and shall take precedence for any provisions specific to that institutional relationship.

2. Accounts, Eligibility & Provisioning

2.1. Account Structures: KarMuqabla supports two primary account models:

2.1.1. Open Accounts: Accounts created directly through self-registration by a parent, legal guardian, or independent educator. Account holders must provide accurate, complete information and maintain the security of their login credentials.

2.1.2. School-Affiliated Accounts: Accounts created, imported, or managed by an authorized partner school, branch, or administrator. Institutional users are responsible for maintaining accurate class rosters and ensuring platform access is granted solely to authorized individuals.

2.2. Minors & Student Accounts:

2.2.1. Prohibition on Student Self-Registration: Student users are typically minors. Students are strictly prohibited from self-registering independent accounts on the platform.

2.2.2. Account Provisioning: Student profiles must be provisioned either directly by an authorized partner school under institutional consent frameworks, or created and linked under a registered parent or legal guardian account.

2.3. Account Security: All users are responsible for safeguarding their account credentials and restricting access to their devices. You must notify KarMuqabla immediately of any suspected breach or unauthorized use of your account.

3. Acceptable Use Policy

3.1. Permitted Purpose: You agree to access and use KarMuqabla solely for genuine educational, instructional, monitoring, and administrative purposes.

3.2. Prohibited Conduct: Users are strictly prohibited from engaging in any of the following activities:

3.2.1. Academic & System Integrity Violations: Cheating in quizzes or tournaments, or using automated scripts, bots, or technical exploits to manipulate scores, leaderboards, streak counts, or coin balances.

3.2.2. Unauthorized Access: Sharing login credentials outside authorized family or school circles, impersonating another individual, or attempting to access student, teacher, or administrative accounts without authorization.

3.2.3. Content Misuse: Scraping, copying, reverse-engineering, decompiling, or redistributing platform source code, software, graphics, or educational content.

3.2.4. Unlawful & Abusive Behavior: Uploading, posting, or transmitting material that is inappropriate for primary/secondary school students, offensive, defamatory, unlawful, or infringing upon third-party intellectual property rights.

3.2.5. Infrastructure Interference: Overloading, probing, damaging, or disrupting KarMuqabla servers, security protocols, or network infrastructure.

4. Intellectual Property & License Grant

4.1. Platform Ownership: All learning modules, video lessons, quiz banks, digital worksheets, branding elements, software, design assets, and user interface layouts remain the exclusive property of KarMuqabla or its licensors.

4.2. Limited Educational License: Users are granted a limited, non-exclusive, non-transferable, revocable license to access and view platform materials solely for personal or authorized classroom educational use.

4.3. Restrictions on Commercialization: You may not sell, sub-license, rent, republish, or commercially exploit any content or software hosted on KarMuqabla without explicit prior written authorization.

4.4. Feedback Grant: Any feedback, suggestions, or ideas submitted regarding platform features or usability may be utilized by KarMuqabla without obligation, restriction, or financial compensation to the contributor.

5. Virtual Economy, Subscriptions & Competitions

5.1. Virtual Coins:

5.1.1. In-App Utility: Coins are performance-based virtual rewards earned solely through platform participation and academic achievement.

5.1.2. No Cash Value: Virtual coins cannot be purchased with fiat currency, carry zero monetary value, cannot be redeemed for cash, and are non-transferable between user accounts.

5.2. Premium Plus Packages & Billing:

5.2.1. Subscriptions: Enhanced features, extended content libraries, and premium access are available via Premium Plus package subscriptions.

5.2.2. Payment Processing: Purchases are processed through secure third-party payment gateways. Subscription pricing, features, and billing cycles are presented at checkout.

5.2.3. Refund Policy: Unless mandated by applicable consumer protection laws or explicitly stated during checkout, all Premium Plus package purchases are non-refundable upon activation. Institutional billing for partner schools is governed separately by institutional contract terms.

5.3. Tournaments & Competitions:

5.3.1. Event Rules: Tournament schedules, eligibility criteria, scoring formulas, and prize specifications are defined per competition.

5.3.2. Verification: KarMuqabla reserves the right to audit participation data and verify student eligibility prior to confirming leaderboard rankings or awarding prizes.

6. Institutional Data & Partner Responsibilities

6.1. Authority & Consent: Partner schools, branch administrators, and institutional sponsors warrant that they possess all requisite legal rights, approvals, and parent/guardian consents to upload student records and manage student platform accounts under applicable educational privacy laws.

6.2. Institutional Policy: Detailed provisions governing school data controllership and institutional onboarding are set forth in the KarMuqabla School Policy.

7. Data Protection & Privacy

7.1. Policy Incorporation: Personal data collection, storage, processing, and protection protocols are governed by the KarMuqabla Privacy Policy, which is incorporated into these terms by reference.

7.2. Data Use Commitment: KarMuqabla does not sell or rent student personal data to third-party advertisers or data brokers.

8. Account Suspension & Termination

8.1. Remedies for Breach: KarMuqabla reserves the right to issue warnings, suspend access, or permanently terminate accounts that violate these terms, engage in fraudulent activity, or compromise platform safety.

8.2. User-Initiated Account Closure: You may delete your account in the app under Settings → Delete account. If you cannot use the app, follow the steps on our Account Deletion Page or contact support. School-managed student accounts should be closed through the school administrator.

9. Warranties & Disclaimers

9.1. Service Provision: KarMuqabla is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied.

9.2. Availability & Accuracy: While we aim for continuous uptime and rigorous curriculum alignment, KarMuqabla does not guarantee uninterrupted, bug-free, or error-free service.

9.3. Limitation of Liability: To the maximum extent permitted by law, KarMuqabla shall not be liable for indirect, incidental, punitive, or consequential damages resulting from your platform usage or inability to access services.

10. Governing Law & Dispute Resolution

10.1. Jurisdiction: These terms are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan.

10.2. Venue: Any legal proceedings or disputes arising from these terms shall be subject to the exclusive jurisdiction of the competent courts in Pakistan, except where an institutional contract specifies a different dispute mechanism.

11. Amendments & Updates

11.1. Modification Right: KarMuqabla reserves the right to modify or update these terms periodically to reflect platform evolution or legal changes.

11.2. Notification: Material revisions will be communicated via in-app banners, email notifications, or platform announcements. Continued use of the platform after updates take effect constitutes acceptance of the revised terms.
